TASTE THE VICTORY CONTEST
OFFICIAL RULES
(the “Rules”)
NO PURCHASE NECESSARY TO ENTER.
1. CONTEST PERIOD AND ORGANIZER. The Taste the Victory Contest (the “Contest”) is organized and administered by Couche-Tard Inc. (the “Organizer”) and is sponsored by Molson Canada 2005 (the “Sponsor”). The Contest begins on February 23, 2022 at 12:00:01 a.m. Eastern Time (“ET") and ends following the last NHL® hockey match eligible for the Contest according to the NHL® calendar for the 2021-2022 regular season (the “Contest Period”). The clock used by the Organizer will be the official clock to determine the date and time of receipt of an Entry (as such term is defined below).
2. ELIGIBILITY. The Contest is open to legal residents of the province of Quebec who are eighteen (18) years of age or older at the time of entry. The following persons are not eligible to enter the Contest: officers, directors, shareholders, employees, agents and/or representatives of the Organizer, the Sponsor, the National Hockey League (“NHL”), its member clubs, NHL Enterprises, L.P., NHL Enterprises Canada, L.P., NHL Enterprises B.V., NHL Interactive CyberEnterprises, LLC, (the foregoing NHL entities, collectively, the “NHL Entities”), and each of their respective subsidiaries, related companies, advertising agencies, licensees, franchisees, partners, retailers, distributors, prize suppliers and/or any other Contest-related party. In addition, any member of the immediate family of the above-mentioned persons and any person housed with them under the same roof (whether or not they are a member of their immediate family) are not eligible to enter the Contest. The term “immediate family” means the fathers, mothers, brothers, sisters, children, husbands, wives or spouses of the above-mentioned persons, regardless of where they live. The Contest is not open and is void where prohibited by law.
3. AGREEMENT TO BE LEGALLY BOUND. By entering this Contest, each entrant agrees to be bound by (i) these Rules; (ii) the terms and conditions of the Couche-Tard mobile application (the “App”); and (iii) all decisions of the Organizer and the Sponsor, which are final in all respects.
4. THE COUCHE-TARD APP. To enter the Contest and be eligible to win a Prize (as such term is defined below), each entrant must: (i) have or download the App; and (ii) have or create an account.
To create an account, open the App or visit the Couche-Tard website at https://www.couche-tard.com/couche-tard-app (the “Website”) and complete the required information, namely, by providing your name, date of birth, email address, telephone number and postal code. Downloading the App, accessing the Website and obtaining an account is free.
5. HOW TO ENTER. NO PURCHASE NECESSARY. Standard Internet access charges may apply (check your service provider package to know your standard Internet access charges).
To enter the Contest for a chance to win a Prize (as such term is defined below), during the Contest Period, open the App and go to the Contest page accessible via the homepage of the App. Once the Contest page opens, entrants will be required to (i) log in to their account; (ii) confirm that they have reached the legal drinking age in Quebec at the time of entry; and (iii) play the Game (as such term is defined below).
Play the Taste the Victory game (the “Game”) by clicking or tapping on the screen to select one (1) of the thirty-two (32) NHL® teams. Once an entrant has selected his/her NHL® team, no further selections or changes can be made during the Contest Period. During each NHL® hockey match eligible for the Contest according to the NHL®calendar played by the selected team during the 2021-2022 regular season (each a "Match"), you will automatically receive: (a) one (1) entry in each Weekly Prize Draw (as such term is defined below) starting as of the Week (as such term is defined below) following the date of your entry and for each following Week (the “Weekly Prize Entry” and collectively, the “Weekly Prize Entries”); and (b) a chance to win a Victory Prize (as such term is defined below) if the selected team wins the Match (the “Victory Prize Entry” and collectively, the “Victory Prize Entries”).
The Weekly Prize Entries and the Victory Prize Entries are each an “Entry” and collectively, the “Entries.”
The Organizer and the Sponsor assume no responsibility for the cancellation, delay, suspension or postponement of a Match. In the event of the cancellation of a Match on the NHL® calendar, Victory Prizes will not be awarded in connection with this Match and these Victory Prizes will be forfeited. Each entrant acknowledges that the occurrence of a Match is beyond the control of the Organizer and the Sponsor.
The entrants must submit each Entry personally. Entries will be deemed to have been submitted by the Authorized Email Account Holder. “Authorized Email Account Holder” of an email address means the physical person to whom the email address has been assigned by the Internet access provider, online service provider or other company responsible for the assignment of the e-mail address account. The eligible winner of a Prize (as such term is defined below) may be required to provide proof of being the Authorized Email Account Holder of the email account associated with the email address. By submitting an email address, you represent and warrant that you are the Authorized Email Account Holder. You will be liable to the Organizer for all damages and other losses suffered by it as a result of your submission of any email address for which you are not the Authorized Email Account Holder. The Organizer reserves the right to: (i) request, at any time, from any entrant, documents proving that they are the Authorized Email Account Holder; and (ii) suspend any entrant, at any time, until such evidence can be provided.
Any attempt by an entrant to obtain more than the specified number of Entries, by using multiple or different email addresses, identities, or any other method will result in the cancellation of that entrant's Entries, and that entrant may be disqualified at the Organizer’s sole discretion. Use of any automated system (including, but not limited to, Entries submitted by means of robots, scripts, macro commands or other automated service) to enter the Contest is prohibited and will result in the entrant’s disqualification.
6. PRIZES. The following Prizes can be won:
(1) Weekly Prize: The following weekly prizes (each a “Weekly Prize” and collectively, the “Weekly Prizes”) are available to be won during the Contest Period, one (1) per Week (as such term is defined below) in accordance with section 7(1) below:

Odds of winning a Weekly Prize depend on the number of eligible Weekly Prize Entries received during the Week immediately preceding each Weekly Prize Draw (as such term is defined below).
(2) Victory Prizes: Following each Match day, a total of four thousand (4,000) Victory Prizes will be available to all entrants whose selected team has won the Match. The following victory prizes (each, a “Victory Prize” and collectively, the “Victory Prizes”) are available to be won during the Contest Period:

The odds of winning a Victory Prize depend on (a) the selected team winning a Match; and (b) the amount of eligible Victory Prize Entries received on the day of the Match.
The Weekly Prizes and the Victory Prizes are each a “Prize” and collectively, the “Prizes.”
The Prizes and their components must be accepted as is and cannot be transferred, substituted or exchanged, in whole or in part, for another prize or cash. Internet access is required to claim a Prize. The conditions of mobile coupons, including the province(s) where these are redeemable and their expiration dates apply.
The Organizer, in its sole discretion, subject to the approval of the Régie des alcools, des courses et des jeux (the “Régie”), reserves the right to: (i) replace all or part of a Prize with another prize or part thereof of equal or greater value; (ii) limit the number of Prizes awarded to the same person, cell phone number, email address or physical address; (iii) limit the number of applicable Prizes that may be redeemed in one transaction and/or period; and (iv) modify the Prizes and associated quantities at any time during the Contest Period. The Organizer will in no way be held responsible for the allocation and/or exchange of items in addition to the Prizes and their respective quantities as indicated above. Prizes may differ from images shown in Contest-related promotional materials. Each Prize may also be subject to additional terms and conditions.
7. SELECTION AND NOTIFICATION. For the purposes of this Contest, a “Day” shall mean a calendar day that begins at 12:00:00 a.m. ET and ends at 11:59:59 p.m. ET and a “Week” shall begin on Wednesday at 12:00:00 a.m. ET and end on Tuesday at 11:59:59 p.m. ET.
(1) Weekly Prizes
The Weekly Prizes Draws will be initiated by a Contest administrator (human) and processed by an algorithm (computer program) that simulates a random draw (a “Random Draw”). Any attempt to manipulate or tamper with the winner selection system or the database of Entries will result in disqualification and possible criminal prosecution.
For each Week during the Contest Period a Random Draw for that Week’s Weekly Prizes will be conducted in Laval, QC where one (1) Entry will be randomly selected from all eligible Weekly Prize Entries received during that Week according to the following schedule (each, a “Weekly Prizes Draw” and collectively, the “Weekly Prizes Draws”):

Limit: one (1) Weekly Prize per entrant and household for the Contest Period. Unselected Weekly Prize Entries for a particular Week will roll over into subsequent Weekly Prizes Draws.
The Organizer or its designated representative will make up to three (3) attempts to contact the selected entrants by email to the email submitted at the time of Entry within five (5) business days following the Weekly Prizes Draw. If the selected entrant: (i) cannot be contacted within three (3) attempts or five (5) business days of being selected (whichever occurs first); or (ii) there is a return of any notification as undeliverable, then the selected entrant will be disqualified and an alternate entrant will be randomly selected from among the remaining eligible Entries received. If time permits, the process noted above will be repeated up to three (3) times, until a selected entrant has been contacted and the Weekly Prize has been awarded or there are no eligible Entries remaining.
(2) Victory Prizes
Following each Match, a Victory Prize will be awarded to the App account of each entrant whose selected team won the Match and the entrant may redeem the Victory Prize in accordance with section 8(2) below. The total number of Victory Prizes available to be won will diminish as they are claimed throughout the Contest.
8. PRIZE AWARDING CONDITIONS.
(1) Weekly Prizes
To be declared a winner and be awarded a Weekly Prize, the selected entrant must: (i) respond to the selection notification within the time period described above; (ii) correctly answer, without assistance of any kind, whether mechanical or otherwise, a time-limited mathematical skill-testing question administered at a mutually agreed upon time; and (iii) otherwise comply with these Rules. As a condition of being declared a winner, the selected entrant may also be required to do any or all of the following: (i) supply proof of age consisting of a legible photocopy of either a provincially issued driver’s license or other government issued identification; (ii) supply proof of address consisting of a legible photocopy of either a provincially issued driver’s license or other government issued identification, (iii) supply proof that they are the Authorized Email Account Holder associated with the selected email address, and (iv) sign and return the Organizer’s Declaration and Release Form (the “Release Form”). The Release Form (among other things): (i) confirms compliance with these Rules and acceptance of the applicable Prize as awarded without substitution; (ii) releases the Organizer, the Sponsor, the NHL Entities, and each of their respective affiliated and related companies, the prize suppliers, advertising and promotional agencies and each of their respective shareholders, directors, officers, employees, agents, dealers, representatives, successors and assigns from any liability in connection with this Contest, the selected entrant’s participation therein and/or the awarding and use/misuse of the Prize or any portion thereof; and (iii) confirms that the winner agrees to the publication, reproduction and/or other use of his/her name, address, voice, statements about the Contest and/or photograph or other likeness, without further notice or compensation, in any publicity or advertisement carried out by the Organizer in any manner whatsoever, including print, broadcast or the Internet. The Release Form must be received by the Organizer within the time period indicated on the Release Form. The Organizer and its agents assume no responsibility for lost, stolen, delayed, illegible, damaged, misdirected, late, or otherwise void Release Forms.
Declining the Prize, failing to correctly answer the mathematical skill-testing question, failing to return the properly executed Release Form within the time period indicated on the Release Form or otherwise failing to comply with these Rules will cause the Prize to be forfeited and a new Random Draw held in accordance with the process for the applicable Prize, as described above.
(2) Victory Prizes
If you are eligible to win a Victory Prize, you may redeem such Victory Prize by presenting your mobile coupon to a participating Couche-Tard location in the region you are playing from. All mobile coupons for a Victory Prize must be redeemed in-store within four (4) days following the Match or before all four thousand (4,000) available Victory Prizes per Match day are redeemed, whichever comes first, after which time the mobile coupon will expire or, as applicable, no longer be available.
9. LIMITATION OF LIABILITY AND DISCLAIMER. By entering the Contest, entrants agree to release and hold harmless the Organizer, the Sponsor, the NHL Entities, and their subsidiaries or related companies, advertising agencies, licensees, franchisees, partners, retailers, distributors and all other Contest-related parties and their respective officers, directors, shareholders, employees, agents, representatives, successors and assigns (collectively, the "Released Parties"), against any claim, cause of action, or liability, including, but not limited to, any injury or death, or any damage or loss to property, arising from entering the Contest or misuse of a Prize.
Without limiting the generality of the foregoing, the Released Parties shall not be liable for: (1) any incomplete or inaccurate information attributable to entrants or to any error related to the programming of the Contest; (2) any technical failures of any kind whatsoever, including but not limited to hardware or software errors; faulty computers; any failures, inaccessibility to the Contest website, in whole or in part, for any reason whatsoever; service interruptions or disconnections of Internet networks or telephone lines; garbled, inconsistent or erroneous data transmissions; failure of any online transmission to be sent or received; (3) unauthorized human intervention at any stage of the Contest registration or entry process; (4) any technical or human error that may occur while running the Contest or processing Entries; or (5) any damage or injury suffered by persons, or any property damage resulting from entering the Contest or from the acceptance, use, implementation or misuse of a Prize. If, for any reason, an entrant’s Entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, then the entrant’s sole remedy is to seek another Entry in the Contest, where possible.
10. PERSONAL INFORMATION. The Organizer and its authorized agents will collect, use and disclose the personal information you provided when entering the Contest for the purposes of running the Contest and awarding Prizes. The winners authorize the Organizer to use their names, photographs, cities, voices, images and/or declarations in connection with their Prizes for Contest-related publicity or other purposes, in any media, including on the Internet, at any time, in perpetuity, without compensation or notice.
The opportunity to receive other communications related to the Organizer’s products, contests and other promotional offers may be offered by the Organizer.

11. RIGHT TO MODIFY, CANCEL, SUSPEND, TERMINATE. The Organizer and its authorized representatives reserve the right, at their sole discretion, subject to the Régie’s approval, and without notice, to cancel, suspend or modify the Contest, in whole or in part, or the entrants' eligibility for any reason whatsoever, including, but not limited to, printing errors, administrative errors, viruses, bugs, unauthorized human intervention, tampering, fraud, equipment failure, security breach or other causes that corrupt or affect the administration, security, fairness or proper conduct of the Contest.
In the event of the postponement or cancellation of the regular season or one or more Matches on the NHL® calendar for the 2021-2022 season, the Organizer and its authorized representatives reserve the right, at their sole discretion, to cancel, suspend or modify the Contest, in whole or in part, subject to the Régie’s approval.
12. GENERAL CONDITIONS. The Organizer reserves the right, at its sole discretion, to exclude from this Contest any person who, in the Organizer’s reasonable opinion, has tampered with, or attempted to tamper with, the entry process, the conduct of the Contest or the Contest website, which violates these Rules or acts contrary to the spirit of the Contest or in a disruptive manner or with the intention of disturbing, insulting, threatening, intimidating or harassing any other person. ANY ATTEMPT BY AN ENTRANT OR OTHER PERSON TO DELIBERATELY DAMAGE THE CONTEST PLATFORM/APPLICATION (OR ANY RELATED WEBSITE) OR TO UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND, IN THE EVENT OF SUCH AN ATTEMPT, THE ORGANIZER RESERVES THE RIGHT TO SEEK DAMAGES FROM SUCH A PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
All of the Organizer’s decisions with respect to all aspects of the Contest are final. The Contest is subject to all applicable federal, provincial and municipal laws. These Rules shall be governed by and interpreted in accordance with the laws of the province of Quebec and the laws of Canada, as applicable therein, without giving effect to the their principles of conflict of laws. All disputes, claims and causes of action arising out of or pertaining to these Rules shall be resolved individually and exclusively by the courts of Laval, Quebec. The invalidity or unenforceability of any provision of these Rules shall not affect the validity or enforceability of any other provision contained in the Rules. If any provision of the Rules is held to be invalid or otherwise unenforceable, then they shall be interpreted according to their conditions, as if the invalid or non-applicable provision were not included in the Rules. Paragraph titles are used for reference purposes only and should not influence the interpretation of the Rules.
Any dispute regarding the conduct or organization of a publicity contest may be submitted to the Régie for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.
