OFFICIAL CONTEST RULES

 

  1. NO PURCHASE NECESSARY. WHITE CLAW HARD SELTZER™ – “Couche-Tard x White Claw Summer Contest” Contest (the “Contest”) is sponsored by Mark Anthony Beverage Distribution Quebec Inc. of 780 Brewster Ave, Suite 02-150, Montreal, QC, H4C 2K1 (the "Sponsor") and is administered by Couche-Tard Inc. (the “Administrator”), as a promotional contest for its products. Contest begins at 12:00:01 am (ET) on July 23rd, 2024 and ends at 11:59:59 pm (ET) on September 16th, 2024 (the "Contest Period").

 

ELIGIBILITY

 

  1. To enter and be eligible to win, the participant must be a legal resident of Quebec and 18 years of age or older at the time of entry in the Contest. Persons are not eligible to enter if they: (a) are an officer, director, employee, representative or agent of the Sponsor, Administrator, Contest Prize Administrator or any of its affiliates or related parties, or of any of its advertising or promotional agencies, contest prize supplier; (b) are an employee of or contractor to any provincial liquor board or authority, any liquor distribution company or any participating licensed establishment; (c) any other parties involved in the Contest; and/or (d) are a member of the immediate family (defined as parents, siblings, children and spouse, regardless of where they live) or household (whether related or not) of any of such persons.

 

  1. Participation constitutes participants’ full and unconditional agreement to these Official Contest Rules and Sponsor and Administrator’s decisions and interpretations, which are final and binding in all matters related to the Contest. Winning a prize is contingent upon fulfilling all requirements set forth herein.

 

HOW TO PLAY

 

  1. How to enter with purchase: Each purchase transaction of a 6 x 355mL pack of White Claw Hard Seltzer™ made at participating Couche-Tard locations (the “Establishment”) during store hours will count as one (1) Contest entry (an “Entry”). For clarity, for each purchase transaction, regardless of the quantity of Qualifying Products purchased, it will only count as one (1) Entry. The Qualifying Product will be scanned at the Establishment’s customer service counter and the computer that scans the Qualifying Product will randomly determine whether the Qualifying Product is a winning Entry. If the Qualifying Product is a winning Entry, a coupon for prize redemption (a “Coupon”) will be provided to the participant.

 

  1. No purchase option: To participate in the Contest without the purchase of a Qualifying Product, a participant may mail a legible, handwritten, original letter of at least one hundred fifty (150) words explaining why he or she would like to win the Prize, accompanied by his or her name, address (including city or town and postal code), date of birth and telephone number (with area code), to Vibrant Marketing of 4020 St-Ambroise St, Office 150, Montreal, QC H4C 2C7. Upon validation of the letter by Vibrant Marketing, the Administrator will carry out an in-store transaction at the Establishment on behalf of the participant (a “Mail-in Entry” or “Entry”) to determine if the Mail-in Entry is a winning Entry. If it is a winning Entry, Vibrant Marketing will attempt to contact each potential winner by telephone for a period of five (5) business days following the Mail-in Entry is determined to be a winning Entry. If a potential winner cannot be contacted within the allotted time, the potential winner is no longer eligible to win the Prize (see Rule 8 and 9 below). In order to be declared a winner, the potential winner agrees to sign the Sponsor's form(s) of Declaration and Release Documents (see Rule 12 below). A participant may submit up to three (3) letters per calendar day during the Contest Period, with different text for each letter and each letter must be mailed in a separate envelop bearing sufficient postage. Letters must be received by 5:00 pm (ET) on September 9th, 2024.

 

  1. Regardless of the method of entry used, there is a limit of three (3) Entries per calendar day per person. Entries must be received during the Contest Period. Sponsor, Administrator and Contest Prize Administrator will not be responsible for illegible, incomplete, lost, misdirected or late Entries, which will be void. Any use of automated devices is prohibited. Sponsor, Administrator and Contest Prize Administrator will not be held responsible for lost, stolen, damaged or destroyed Coupons. Coupons obtained through unauthorized sources or which are incomplete, copied, duplicated, mutilated, altered, reproduced, forged, counterfeited or irregular in any way, are automatically void.

 

  1. The odds of being selected for the Prize depend on the total number of eligible Entries received during the Contest Period. The total number of Prizes available to be won will decrease throughout the Contest Period as Coupons are distributed and Prizes are claimed.

 

PRIZES

 

  1. There are twenty (20) individual prizes to be won (each, a “Prize”). The Prize consists of either: one (1) Wakesurf, one (1) Yeti Cooler or one (1) circle raft. The quantity and approximate retail value (“ARV”) of the Prizes are as follows:

    1. Wakesurf (10 total): The ARV of each Wakesurf is CAD $550. The ARV of all Wakesurf Prizes is CAD $5,500. No more than three (10) wakesurf Prizes will be awarded.

 

 

  1. Yeti Cooler (5 total): The ARV of each Yeti Cooler is CAD $450. The ARV of all Yeti Cooler Prizes is CAD $2,250. No more than three (5) Yeti Cooler Prizes will be awarded.

 

  1. Circle raft (5 total): The ARV of each circle raft is CAD $30. The ARV of all Bike Prizes is CAD $150. No more than four (5) circle raft will be awarded.

 

  1. Total ARV: The ARV of all Prizes in this Contest is CAD $7,900.

 

  1. The Prizes are provided by the Sponsor. The Prize is non-transferable and must be accepted as awarded. The Sponsor reserves the right, for any reason whatsoever, in its sole and absolute discretion, to award a substitute prize of equivalent monetary value or greater value, including without limitation, a cash award, if a prize cannot be awarded as described. Arrangements for Prize delivery will be confirmed with the winners by e-mail or telephone. The Prize will only be released to the verified winners. Return of any prize/prize notification as undeliverable may result in disqualification and selection of an alternate winner. 

 

  1. None of the Released Parties (as defined below) makes any representation or offers any warranty, express or implied, as to the quality or fitness of any Prizes awarded in connection with the Contest. To the fullest extent permitted by applicable law, the winner understands and acknowledges that he/she may not seek reimbursement or pursue any legal or equitable remedy from either the Sponsor, Administrator or any of the other Released Parties should the Prize fail to be fit for its purpose or is in any way unsatisfactory.

 

HOW TO CLAIM A PRIZE AND SKILL-TESTING QUESTION

 

  1. To claim a Prize with the Coupon provided by the Establishment, contact Vibrant Marketing (the “Contest Prize Administrator”) by email at leac@vibrantmarketing.ca or telephone at (514) 967-7155. Once a winner claims a Coupon for prize redemption, the Contest Prize Administrator will randomly select the Prize the winner will receive. For clarity, the winner will have a chance to win either: one (1) Wakesurf, one (1) Yeti Cooler or one (1) circle raft. The deadline to claim a Prize is 5:00 pm (ET) on October 1st, 2024.

 

  1. In order to be declared a winner, the potential winners of the Prize must (1) provide his or her name, address, phone number and date of birth (for age eligibility); (2) correctly answer, unassisted, whether mechanical or otherwise, an arithmetic skill-testing question; and (3) complete, sign and return to the Contest Prize Administrator a Declaration of Compliance with the Contest Rules and a Release of Liability within two (2) business days of delivery of same by the Contest Prize Administrator, confirming compliance with the Contest Rules and regulations and releasing the Sponsor, Administrator, Contest Prize Administrator, their respective advertising and promotional agencies, provincial liquor authorities, parent companies and affiliates of the foregoing and all their respective directors, officers, owners, partners, employees, agents, representatives, successors and assigns (collectively the “Released Parties”) from any and all liability of any kind in connection with the Contest, or occurring as a result of the Prize being awarded. The winners irrevocably authorizes the Sponsor and/or Administrator to broadcast, publish and disseminate his/her name, address, photograph, likeness or other image, voice and/or statements, in connection with any advertising, promotion, publicity, and/or for general news, entertainment, marketing and information purposes at no compensation (other than the Prize) to the winners. No participant will be declared a winner until his/her compliance with these Contest Rules has been verified. Declaration of Compliance and Release documents must be returned within the time period indicated on the documents or as requested by the Contest Prize Administrator, or the Prize will be forfeited. 

 

GENERAL RULES

 

  1. The provincial liquor agencies are not in any way associated with this Contest nor are they liable in any way whatsoever in regard to any matter which relates to this Contest.

 

  1. Entries may not be given or sold to anyone else, and the Sponsor reserves the right to refuse to accept an Entry if the Sponsor considers the Entry to have been submitted by an ineligible person or through any mechanical, electronic or other automated means of submission. All participants must prove their eligibility with valid photo identification and proof of residency, upon request.

 

  1. This Contest is void where prohibited by law and is subject to all applicable federal, provincial and municipal laws and regulations. All incidental costs and expenses not specifically referred to herein including (without limitation) federal, provincial and local taxes, shall be the responsibility of the prize winners.

 

  1. If the identity of the winner is disputed, the winner will be deemed to be the person in possession of the Coupon at the time a claim is made for a Prize by contacting the Contest Prize Administrator. The sole determinant of time for the purposes of receipt of a valid Entry in this Contest will be the Establishment's network equipment.

 

  1. All decision(s) of the Sponsor, Administrator and Contest Prize Administrator, are final and binding with respect to all aspects of the Contest, including, without limitation, eligibility and/or disqualification of Entries. All Entries are the property of the Sponsor. Any litigation respecting the conduct or organization of the Contest may be submitted to the Régie des alcools, des courses et des jeux (the “Régie”) for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie for the purpose of helping the parties reach a settlement.

 

  1. By entering the Contest, participants agree to abide by and be bound by these Contest Rules and the decisions of the Sponsor, Administrator and Contest Prize Administrator which are final. Participants who have not complied with these Contest Rules are subject to disqualification. ANY ATTEMPT BY A PARTICIPANT OR ANY OTHER PERSON TO DELIBERATELY DAMAGE THE CONTEST WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND, SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR AND/OR ADMINISTRATOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.

 

  1. By entering this Contest, each participant agrees to save and hold harmless the Sponsor, Administrator, Contest Prize Administrator and its affiliates, the suppliers of the Prize and their respective employees, officers, directors and agents from any and all liability for harm which the winners may suffer as a result of participation in the Contest, compliance or non-compliance with these Contest Rules and acceptance and use of the Prize, and the winners agree to sign the Sponsor's form(s) of Declaration of Compliance and Release of Liability and Publicity Release documentation (see Rule 12 above) in this regard before receiving his/her Prize. The Sponsor, Administrator and Contest Prize Administrator shall not bear any liability arising from or in any way relating to the Contest or the Prize awarded.

 

  1. The Sponsor reserves the right to change the terms of the Contest or terminate it at any time, without prior notice, if required, except to the Régie. Without limiting the generality of the foregoing, if for any reason in the sole opinion of the Sponsor the Contest is not capable of running as planned or if the administration, security, fairness, integrity or proper conduct of the Contest is corrupted or adversely affected, including by reason of tampering, fraud, technical failures or any other reason beyond its control, the Sponsor reserves the right to cancel, terminate, modify or suspend the Contest, including selecting winners and/or additional winners from previously received valid Entries.

 

  1. By entering this Contest, the winners consent and agree to the use by the Sponsor and/or the Administrator or their agents of the winners’ name, city of residence, photograph, likeness or other image, voice and/or statements for any and all publicity purposes, commercial or otherwise, in any and all media without compensation (other than the Prize) of any kind or further notification.

 

  1. The Sponsor, Administrator and Contest Prize Administrator assumes no responsibility for lost, delayed, incomplete, garbled, undelivered, damaged or misdirected Entries or for any technical problems of any kind affecting the operation or administration of this Contest, including, without limitation, any technical malfunction or failure of, or any other problem with, any computer hardware or software or any telephone network or lines or broadcast transmission during the Contest Period. The Sponsor, Administrator and Contest Prize Administrator will not be responsible for any injury or damage to the participant's or any other person's computer relating to or resulting from participation or downloading any materials in this Contest.
